Visa® Gift Card Terms and ConditionsImportant Information for Gift RecipientThese are your Nevada Federal Visa® Gift Card Terms and Conditions. Please read them carefully and keep them for your records. Please sign your card immediately. By accepting and using your Nevada Federal Gift Card, you agree to be bound by these Terms and Conditions. In these Terms and Conditions, “you” or “your” means the person who has received the Nevada Federal Visa® Gift Card; “we”, “us”, or “our” means Nevada Federal Credit Union; “Card” means the Nevada Federal Visa® Gift Card. Please read the following carefully and keep them for your records. Gift Card UsageSection 1. Lost or Unauthorized Usage Contact InformationContact Nevada Federal at once in the event that your Card has been lost or stolen: Section 2. Activation, Types of Available Transfers, and Limits of TransfersPoint-of-Sale Transactions. Your Nevada Federal Visa® Gift Card is issued by Nevada Federal Credit Union and may be used for purchases at most merchants where Visa® Debit is accepted. The card may not be used at some merchants including airlines, recurring payments, and non-financial money exchange establishments, hotels, gambling establishments, rental car agencies, or “pay at the pump” gasoline. (You may purchase gas by presenting the card to the attendant). Some merchants, like restaurants, may attempt to submit authorizations against the card for an amount greater than the actual purchase amount. If a merchant attempts an authorization greater than the balance remaining on your gift card, it may be declined. No Limitation on Frequency of Point-of-Sale and Cash Transactions. There is no limitation on the frequency of any of the transactions available for the Card. Transaction Limitations. This Card is not a credit card. You may only use it when there is a balance remaining on the Card and only up to the amount left on the Card. Purchases will be deducted from your Nevada Federal Visa® Gift Card until the value reaches zero. If you are given value through the use of the Card greater than the balance remaining, you will pay us on demand the amount by which your transactions exceeded the balance remaining on the Card. Conversions to U.S. Dollars. If you use your Card for a transaction in a foreign currency the transaction will be converted to U.S. dollars in accordance with applicable Visa® operating regulations for international transactions. The conversion rate in dollars will be a rate selected by Visa® from a range of rates available in wholesale currency markets for the applicable Central Processing Date, which rate may vary from the rate Visa® itself receives, or the government mandated rate in effect for the applicable Central Processing Date in each instance, plus or minus any adjustment determined by the issuer. Section 3. Your Liability for a Lost Card or Unauthorized TransfersUnder policies governed by Nevada Federal Credit Union, you may incur no liability for unauthorized use of your Card provided that you notify us within a reasonable time after learning of the loss or theft of your Card. This policy is subject to the following conditions: “Unauthorized Use” defined. A transaction is considered “unauthorized” if it is initiated by someone other than you without your actual or apparent authority, and you receive no benefit from the transaction. A transaction is not considered unauthorized if (1) you furnish the Card, Card number or other identifying information to another person and expressly or implicitly give that individual authority to perform one or more transactions, and the person exceeds that authority; or (2) for any other reason, we conclude that the facts and circumstances do not reasonably support a claim of unauthorized use. “Reasonable time” defined. Reasonable time will be determined in our sole discretion based on the circumstances but will not be less than sixty (60) days from the transaction date. Other considerations. We may deny you the benefit of the policy if (1) we ask you for a written statement, affidavit or other information in support of the claim, and you do not provide it within the time requested or within a reasonable time if no date is stated; or (2) under any other unusual circumstances where we believe denial is appropriate. Limitation of our Liability. Our liability under this policy is limited to reimbursing you for the amount of your loss up to the face amount of any unauthorized transaction. We are not liable for any special, indirect or consequential damages. Section 4. Expiration of the CardAll Gift Cards have a two year expiration date. Section 5. Disclosure of Information to Third PartiesWe will disclose information to third parties about your Card or the transaction that you make:
Section 6. No Pre-Authorized Transfers AllowedYou may not make pre-authorized regular payments through the use of your Card. Section 7. Credit Union Liability For Failure to Make TransfersIf we do not complete a transaction arising from the use of your Card on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance:
Section 8. Governing Law/SeverabilityThis Agreement will be governed by the laws and regulations of the United States and, to the extent not so covered, by the laws and regulations of the State of Nevada. A determination that any part of these Terms and Conditions is invalid or unenforceable will not affect the remainder. Section 9. Schedule of Fees and ChargesGift Card Fees: The Nevada Federal Credit Union Visa® Gift Card cannot be reloaded once the balance is depleted. There is no limitation on the frequency of any of the transactions available for the card. Card values range from $20 to $500. There is a $5.00 per card issuance fee and a $5.00 lost or stolen card replacement fee (if applicable). A $1.25 monthly account maintenance fee will be assessed after six months from gift card load date and a $2.50 monthly inactive card fee will be assessed after six months of non-use. Unlimited balance and transaction information is available free of charge online at our Gift Card web site. One initial automated telephone inquiry will be free of charge. Subsequent calls to the automated telephone response system will incur a $.75 per call inquiry fee charged to the gift card balance. Phone requests to be transferred to a live agent will result in a $3.55 service fee charged to the gift card balance. Other terms and conditions may apply. Ask for details. |
